Gallop AI Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and 8SIAN SIGNS LLC ("Gallop AI", "we", "us", or "our") governing your use of the Gallop AI website and mobile applications (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy, which explains how we collect and use your information and is incorporated into these Terms by reference.

1. Who Can Use the Service

The Service is intended only for users who are 18 years of age or older. When you create an account, you represent that you are at least 18 years old and that you have the legal capacity to enter into these Terms. If you are under 18, please do not use the Service.

You are also responsible for making sure that using the Service, including viewing odds, race information, or AI-generated predictions, is legal in the place where you live. We do not verify this for you.

You are responsible for ensuring that you meet all applicable legal age requirements for any third-party wagering services you choose to use.

2. What Gallop AI Is, and What It Is Not

Gallop AI provides horse racing information, statistics, and AI-generated predictions and suggestions ("AI Predictions") for entertainment and informational purposes.

Gallop AI is not a betting or wagering operator. We do not accept wagers, process bets, or hold funds on your behalf for the purpose of gambling. Any wagering you choose to place happens entirely through third-party, independently licensed wagering platforms or racetracks. Your relationship with those platforms is governed by their own terms, and we are not a party to it.

Gallop AI does not broker, arrange, facilitate, or endorse any particular wagering transaction or wagering platform, and users make independent decisions regarding whether and how to place wagers.

3. AI Predictions Are Not Betting Advice

This is the most important section of these Terms. Please read it carefully.

  • AI Predictions, win probabilities, speed indexes, and any other analysis we provide are generated using statistical models and historical data. They are estimates, not guarantees, and they can be wrong.
  • AI Predictions are provided for informational and entertainment purposes only. They do not constitute betting advice, financial advice, or a recommendation to wager any amount of money.
  • Horse racing outcomes are inherently unpredictable and depend on many factors outside our control, including the horse's condition on race day, track conditions, and human decisions.
  • You are solely responsible for any wagering decisions you make, and for any losses that may result. We are not responsible for the accuracy of our predictions or for any financial outcome connected to your use of them.
  • Nothing in the Service should be understood as an offer, endorsement, or encouragement to gamble. If gambling is stressful for you or someone you know, resources such as the National Council on Problem Gambling (1-800-522-4700) are available.

4. Your Account

  • You must provide accurate information when creating your account and keep it up to date.
  • You are responsible for keeping your password confidential and for all activity that happens under your account.
  • You may not share your account with others or let someone else use it to access the Service.
  • Notify us immediately at info@gallopai.ai if you believe your account has been compromised.

5. Subscriptions and Payment

  • Certain features of the Service require a paid subscription. Prices and available plans are shown in the Service at the time of purchase.
  • Payments are processed by Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • You can cancel your subscription at any time through your account settings.
  • Fees are non-refundable except where required by applicable law.
  • Cancellation becomes effective at the end of the current billing period.
  • You will retain access through the remainder of the paid subscription term.
  • If a payment fails, we may suspend your access to paid features until the issue is resolved.
  • We may change our prices from time to time. If we do, we will give you reasonable notice before the change applies to your next billing cycle.

6. Acceptable Use

When using the Service, you agree not to:

  • Use automated tools (bots, scrapers, crawlers) to access, copy, or extract data from the Service without our prior written permission
  • Attempt to reverse engineer, decompile, or otherwise access the underlying models or source code of the Service
  • Use the Service for any unlawful purpose, including in a jurisdiction where wagering on horse racing is illegal
  • Impersonate another person, or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the operation of the Service, including through unauthorized access attempts or introducing malicious code
  • Resell, sublicense, or redistribute the Service or its content without our written permission

We may suspend or terminate your account if we reasonably believe you have violated this section.

7. Intellectual Property

  • The Service, including its design, text, graphics, logos, AI models, and underlying software, is owned by Gallop AI or our licensors and is protected by intellectual property laws.
  • We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
  • You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer any part of it, except as permitted by law.
  • Questions you submit to our AI assistant, and content you otherwise create within the Service, remain yours, but you grant us a license to use them as described in our Privacy Policy to provide and improve the Service.

8. Third-Party Services and Links

The Service may contain links to, or integrate with, third-party services, including payment processors, wagering platforms, and advertising partners. We do not control these third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is subject to that party's own terms and privacy policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI PREDICTION OR RACE DATA WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GALLOP AI AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY WAGERING DECISIONS MADE IN RELIANCE ON AI PREDICTIONS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service.
  • Sections of these Terms that by their nature should survive termination (including Sections 3, 5, 7, 9, 10, and 12) will continue to apply after your account is closed.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), with the arbitration seated in Los Angeles, California, before a single arbitrator. Either party may bring an individual claim in small claims court instead of arbitration where the claim qualifies.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" above. If the changes are significant, we will provide a more visible notice, such as an in-app message or email. Continuing to use the Service after changes take effect means you accept the updated Terms.
